These Terms and Conditions govern your access to and use of the website shop.stopbyhairtools.com and any related sales channels operated by Stopby Hairtools Limited (“Stopby Hairtools,” “we,” “us,” or “our”), a company registered in Ghana with its principal place of business at Accra Newtown Market Street, Accra, Ghana.

By accessing this website, placing an order, or otherwise transacting with Stopby Hairtools, you (“Customer,” “you,” or “your”) acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions in full. If you do not agree, you must not use this website or place any orders.

2.1 Age Requirement. You must be at least 18 years of age to make a purchase through this website. By placing an order, you represent and warrant that you meet this requirement.

2.2 Accuracy of Information. You agree to provide accurate, current, and complete information when placing an order, creating an account, or otherwise interacting with this website.

3.1 Product Descriptions. We make reasonable efforts to ensure that product descriptions, images, and specifications displayed on this website are accurate. However, we do not warrant that product descriptions, colours, images, or other content are error-free, complete, or current. Slight variations in colour or appearance may occur due to screen display settings.

3.2 Availability. All products are subject to availability. We reserve the right to discontinue any product at any time without prior notice.

3.3 Product Use. Hair tools and electrical products must be used in accordance with the manufacturer’s instructions. Stopby Hairtools accepts no liability for damage, injury, or loss resulting from misuse, improper handling, or failure to follow the manufacturer’s instructions.

3.4 Manufacturer Warranties. Certain products sold through this website may carry a manufacturer’s warranty. Where a manufacturer’s warranty applies, the terms and duration of that warranty are set by the manufacturer, not by Stopby Hairtools. We will assist you in directing any warranty claim to the relevant manufacturer but do not independently warrant the products beyond what is required by applicable law.

4.1 Order Placement. An order placed through this website constitutes an offer to purchase the selected products. We reserve the right to accept or decline any order at our sole discretion, including where: (i) the product is out of stock; (ii) there is a pricing or product description error; (iii) we are unable to verify your payment; or (iv) we suspect fraud or unauthorized activity.

4.2 Order Confirmation. An order is confirmed and a binding contract is formed only when we send you an order confirmation via email or other communication channel. Until that point, no contract exists between you and Stopby Hairtools.

4.3 Pricing. All prices displayed on this website are in Ghanaian Cedis (GHS) unless otherwise stated and are inclusive of applicable taxes unless separately indicated at checkout. Prices are subject to change without notice, but changes will not affect orders that have already been confirmed.

4.4 Payment Methods. We accept payment via: (i) MTN Mobile Money (MoMo); (ii) direct bank transfer; and (iii) online payment through Hubtel. All payments must be received in full before an order is processed for dispatch.

4.5 Payment Security. Online payments processed through Hubtel are subject to Hubtel’s own terms of service and security protocols. Stopby Hairtools does not store your card details or mobile money PINs.

5.1 Dispatch. All orders are dispatched within 24 to 48 hours of confirmed payment, subject to product availability.

5.2 Delivery Partners. Stopby Hairtools does not operate its own delivery fleet. All deliveries are fulfilled through third-party couriers and dispatch partners. For deliveries within Accra, we recommend trusted dispatch partners we have established working relationships with. For deliveries outside Accra and international shipments, we present available delivery options for your selection and consent before dispatch.

5.3 Delivery Timeframes. Estimated delivery timeframes vary by destination and courier. Because delivery is handled by independent third-party couriers, Stopby Hairtools does not control and cannot guarantee specific delivery dates or transit times once an order has been handed to the courier.

5.4 Risk of Loss. Risk of loss and damage to products passes to you at the point the order is handed over to the third-party courier or dispatch partner for delivery.

5.5 Dispatch Confirmation. Upon dispatch of your order, Stopby Hairtools will provide you with confirmation of handover as follows: (i) for orders fulfilled through internationally recognised shipping carriers such as DHL, FedEx, or similar services, we will provide you with a shipment tracking number and carrier details so you can monitor delivery progress directly; (ii) for all other orders fulfilled through local or regional couriers and dispatch partners, we will provide you with a dispatch receipt containing the driver’s name, contact telephone number, and vehicle registration number. You are responsible for using the information provided to follow up on the status of your delivery.

5.6 Lost or Undelivered Shipments. If your order does not arrive within a reasonable period after the estimated delivery timeframe, you must notify us within 14 days of the estimated delivery date. Upon receiving your notification, Stopby Hairtools will assist as follows: (i) for tracked shipments fulfilled through internationally recognised carriers, we will cooperate with you in filing a claim with the carrier and will provide the carrier with any dispatch records, tracking data, or other documentation within our possession that supports the claim; (ii) for non-tracked shipments fulfilled through local or regional couriers, we will provide you with the dispatch receipt and driver details issued at handover to support your inquiry with the courier, but we are unable to file or pursue a carrier claim where no tracking record exists. For clarity, Stopby Hairtools’ obligation under this section is limited to the reasonable cooperation and assistance described above. We do not guarantee the outcome of any carrier claim and are not liable for the value of lost or damaged shipments once risk has passed to you under Section 5.4.

5.7 Shipping Costs. Shipping and delivery costs are calculated based on your delivery destination and the courier selected. Applicable charges will be displayed or communicated to you before dispatch, and you must consent to the delivery method and cost before the order is shipped.

5.8 Customs, Duties, and Import Taxes. For international orders shipped outside Ghana, you are solely responsible for all customs duties, import taxes, brokerage fees, and any other charges imposed by the destination country. These charges are not included in our product prices or shipping fees and are not collected by Stopby Hairtools. If you refuse delivery or fail to pay any required customs or import charges, resulting in the return or destruction of the shipment, you will not be entitled to a refund of the product price or shipping costs.

5.9 Full Terms. Shipping and delivery are subject to our separate Shipping and Delivery Policy, available on this website, which forms part of these Terms and Conditions.

6.1 Return Window. You may request a return within 7 days of receiving your order, provided the item is unused, in its original condition, and in its original packaging with all accessories, tags, and proof of purchase.

6.2 Non-Returnable Items. Certain items are not eligible for return, including opened or used hair accessories, consumable hair care products, clearance or final sale items, and gift cards.

6.3 Defective or Damaged Items. If you receive a defective, damaged, or incorrect item, you must notify us within 48 hours of delivery with your order number, a description of the issue, and photographs or video evidence.

6.4 Refund Processing. Approved refunds are processed within 7 to 14 business days to the original payment method or another mutually agreed method.

6.5 Full Terms. Returns, refunds, and exchanges are subject to our separate Return and Refund Policy, available on this website, which forms part of these Terms and Conditions.

7.1 Account Creation. You may be required to create an account to access certain features of this website or to place orders. You agree to provide accurate and complete information when creating your account and to keep your account information up to date.

7.2 Account Security. You are responsible for maintaining the confidentiality of your account credentials, including your password. You are responsible for all activity that occurs under your account, whether or not you authorized that activity. You must notify us immediately at info@stopbyhairtools.com if you become aware of any unauthorized use of your account or any other breach of security.

7.3 Account Suspension and Termination. We reserve the right to suspend or terminate your account at any time if we reasonably believe that: (i) you have breached these Terms and Conditions; (ii) your account has been used for fraudulent or unauthorized activity; or (iii) continued access to your account poses a security risk. We will make reasonable efforts to notify you before or promptly after any suspension or termination, unless doing so would compromise security or an ongoing investigation.

8.1 Ownership. All content on this website, including but not limited to text, graphics, logos, images, product photographs, and software, is the property of Stopby Hairtools Limited or its licensors and is protected by applicable intellectual property laws.

8.2 Restrictions. You may not reproduce, distribute, modify, display, create derivative works from, or otherwise use any content from this website for commercial purposes without prior written consent from Stopby Hairtools.

By using this website, you agree not to: (i) use the website for any unlawful purpose or in violation of any applicable law; (ii) interfere with or disrupt the operation of the website or its servers; (iii) attempt to gain unauthorized access to any part of the website; (iv) submit false, misleading, or fraudulent orders or information; or (v) use automated tools to scrape, extract, or collect data from the website without our prior written consent.

Your personal data is collected, processed, and stored in accordance with our Privacy Policy, available on this website, and in compliance with the Data Protection Act, 2012 (Act 843) of Ghana. By using this website and placing orders, you consent to the collection and use of your information as described in the Privacy Policy.

11.1 Payment Processors and Couriers. Our website integrates with third-party service providers, including Hubtel for payment processing and independent courier companies for delivery. These providers operate under their own terms and privacy policies. Stopby Hairtools is not responsible for the acts, omissions, or policies of any third-party service provider.

11.2 External Links. This website may contain links to third-party websites. We do not endorse, control, or accept responsibility for the content, privacy practices, or terms of any linked third-party websites.

12.1 General Limitation. To the fullest extent permitted by the laws of Ghana, Stopby Hairtools Limited, its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunity, or goodwill, arising out of or in connection with your use of this website or purchase of any product.

12.2 Maximum Liability. Stopby Hairtools’ total cumulative liability to you in connection with any order shall not exceed the total amount you paid for that specific order.

12.3 Force Majeure. Stopby Hairtools shall not be liable for any failure or delay in performing its obligations where such failure or delay results from events beyond its reasonable control, including but not limited to natural disasters, pandemics, government restrictions, power outages, internet or telecommunications failures, courier delays, civil disturbance, or acts of war.

13.1 Website Availability. This website is provided on an “as is” and “as available” basis with respect to its operation and availability. Stopby Hairtools does not warrant that the website will be uninterrupted, error-free, or free from viruses or other harmful components.

13.2 Product Warranties. To the fullest extent permitted by applicable law, including the Sale of Goods Act, 1962 (Act 137), Stopby Hairtools disclaims all warranties, express or implied, that are not required by statute. Nothing in these Terms and Conditions is intended to exclude or limit any statutory rights you may have as a consumer under the laws of Ghana, including implied conditions as to merchantability or fitness for a particular purpose where such conditions cannot be lawfully excluded.

You agree to indemnify, defend, and hold harmless Stopby Hairtools Limited, its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to: (i) your breach of these Terms and Conditions; (ii) your misuse of the website or any product purchased; or (iii) your violation of any applicable law or the rights of any third party.

15.1 Governing Law. These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Ghana.

15.2 Dispute Resolution. Any dispute arising out of or in connection with these Terms and Conditions shall first be resolved through good-faith negotiation between the parties. If a dispute cannot be resolved through negotiation within 30 days, either party may submit the matter to the courts of competent jurisdiction in Accra, Ghana.

If any provision of these Terms and Conditions is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force and effect.

Stopby Hairtools reserves the right to update or modify these Terms and Conditions at any time. We will notify you of material changes by posting a notice on the website homepage or by sending a notification to the email address associated with your account at least 7 days before the changes take effect. For non-material changes, the updated Terms and Conditions will be posted on this website with a revised effective date. Your continued use of the website after any changes take effect constitutes your acceptance of the updated Terms and Conditions.

These Terms and Conditions, together with our Privacy Policy, Shipping and Delivery Policy, and Return and Refund Policy, constitute the entire agreement between you and Stopby Hairtools Limited with respect to your use of this website and purchase of products.
